A Grafton County grand jury this month reindicted Nancy Allison on a felony count of negligent homicide in connection with the collision on Old Route 10, which killed Enfield resident John Polinski.
Allison’s attorney, Patrick Hayes, of Lebanon, called the situation “an unfortunate accident” that shouldn’t have given rise to a criminal charge.
“She feels terrible about it,” Hayes said of Allison, declining to elaborate on the circumstances surrounding the accident. “It’s a tragic accident. We think it is should be a noncriminal matter.”
Reached by phone, Allison’s husband, Blake, referred comment to Hayes.
Allison was first indicted on the charge in May, a count that prosecutors dropped. At that time, Grafton County Attorney Lara Saffo declined to elaborate on the rationale for that decision. Saffo again declined to comment about the new indictment.
The new August indictment doesn’t explain why prosecutors believe Allison acted negligently.
Polinski, 73, was a lifelong Upper Valley resident, graduating from Enfield High School in 1962, according to his obituary.
