WOODSTOCK โ The judge presiding over the case of an Upper Valley man facing child sexual abuse and child pornography charges whose trial has been postponed several times wants the defendant to go before a jury soon.
Windsor County Superior Court Judge Heather Gray termed the case “trial ready.” She denied defendant Wayne Miller’s motion for an interlocutory appeal to consider a matter of law related to the collection of evidence, which differs between federal court districts.
“The court does not see any reason why the matter will not proceed to trial this fall,” Gray wrote in her July 22 order denying the defense’s motion for interlocutory appeal.
The “court cannot find that an appeal … will advance resolution of this case,” she added.
A scheduled trial of Miller, 37, who has been held in pretrial detention since he was charged in late 2021, was delayed for the fourth time in May.
At the time, defense attorneys said that Miller was incapable to โparticipate effectivelyโ in his defense due to withdrawal effects from prescribed medications denied by prison officials.
Miller’s case has been scheduled for a pretrial conference in Windsor County court on Sept. 8, according to the state court calendar.
