Barre, Vt.
David Gilbo allegedly hit and killed David Elder, 55, at the P&H Truck Stop as Elder performed maintenance on an underground storage tank cover, police said in a news release announcing the incident in September 2017.
A lengthy police investigation then ensued.
Gilbo had been stopped at the gas pumps and allegedly struck Elder as he drove away, the release said. Elder died on scene.
Gilbo will answer to one count of grossly negligent operation with death resulting at 8 a.m. in a Washington County courthouse, according to a news release police issued on Wednesday.
The maximum penalty for someone convicted of that charge is 15 years in prison, $15,000 in fines, or both.
Correction
David Gilbo faces a maximum penalty of 15 years in prison and up to $15,000 in fines if he is convicted of gross negligent operation of a vehicle with death resulting. An earlier version of this story gave the maximum penalties for a lesser charge.
