David Anthony Kendall currently is being held without bail at Southern State Correction Facility on allegations that he assaulted a girl under the age of 13 over a two-year period.
Kendall has petitioned the court to let him reside with a friend in Brookfield, Vt., but probation officers said the home “is not appropriate” for the program. There is no home phone line or cellphone service, so electronic monitoring wouldn’t function, DOC said in a notice to Windsor Superior Court Judge Timothy Tomasi last week. Young children also frequent a nearby home, the notice states.
Kendall appeared on Tuesday in the White River Junction courthouse, and his defense asked for more time to be able to address the problems, according to Deputy Windsor County State’s Attorney Heidi Remick. The judge will take up the matter again in about three weeks, she said.
Kendall was arraigned on eight felony charges last month. He has pleaded not guilty.
Vermont State Police and the Department of Children and Families learned about the situation on March 1 after the child came forward and disclosed the alleged abuse, according to an affidavit written by Hartford police officer Kristinnah Adams.
Kendall is accused of sexually assaulting the girl, who was known to him, several times between January 2016 and January 2018, according to court documents.
In an interview with police, Kendall first denied any wrongdoing but later acknowledged touching the girl inappropriately, the affidavit states.
