The board ruled in August that an old farm path connecting Route 5 and Kendall Station Road should be closed because of poor visibility and dangerous winter conditions, but also set out a process whereby the railroad should submit a work plan for approval.
The railroad began ripping up the crossing last week, prompting a neighbor, John Roback, to complain to the board that the company had not followed these steps.
Appeals are underway on behalf of both sides in the case. The railroad is disputing the board’s conditions for closure, and Roback and other residents are trying to keep the crossing open.
“The Washington County Railroad Company is hereby ordered and summoned to appear before the Board … to address the Roback allegations,” the board said in a letter dated on Thursday.
The board added that the railroad would need to show why Roback’s allegations should not be referred to the Vermont Attorney General’s Office for enforcement or result in a fine against the railroad.
A hearing is scheduled for 10 a.m. on Oct. 13 at Tracy Hall in Norwich.
