Herb Durfee, 55, pleaded not guilty in Vermont Superior Court in Burlington on Tuesday to a charge of driving while under the influence of alcohol during the crash at about 1 a.m. on Feb. 10.
Durfee declined to comment as he left criminal court.
Judge Nancy Waples released Durfee on conditions, including he report to the state police barracks in Williston within 3 days for his mugshot and fingerprints.
Durfee is due back in court on May 30 for a status conference in the case.
Trooper Vienna Valenti said police had to obtain a search warrant from a state judge at 5:43 a.m. the day of the crash to have Durfee’s blood drawn at the University of Vermont Medical Center. The 0.111 percent reading is an estimate based on the time of the crash, the trooper said.
Durfee received multiple injuries, including a collapsed lung, and was unconscious after the crash, officials said.
