ROYALTON — A 47-year-old Royalton resident shot another man in the leg outside his Happy Hollow Road home in self-defense and won’t face criminal charges, authorities said on Tuesday.

Vermont State Police said the victim, Nicholas Schultz, 23, of Prescott Valley, Ariz., had been staying at the house and left with a firearm on the evening of April 15, but returned a little while later and was still carrying the weapon.

“When Mr. Schultz continued advancing toward the home and failed to comply with commands from the homeowner, Jason Farina, to put down his weapon, Mr. Farina fired his own gun,” State Police said in a news release.

Schultz was taken to Dartmouth-Hitchcock Medical Center and released the next day. Farina was never arrested, and police at the time said there was no risk to the general public.

The Windsor County State’s Attorney reviewed the State Police investigation of the case and decided no charges would be filed in the incident.

“The investigation determined the shooting was a justified use of force in self-defense,” the news release said.
